Gujarat High Court Just Banned AI From the Bench. American Courts Should Pay Attention.

India’s Gujarat High Court issued the most comprehensive judicial AI ban in the world, prohibiting artificial intelligence from any form of judicial decision-making, evidence evaluation, sentencing analysis, or bail considerations across its entire district judiciary. The policy applies to every judicial officer, court staffer, legal assistant, intern, and contractor under its supervision. What the Gujarat Policy Actually Says
The core prohibition is absolute. AI cannot be used for any form of decision-making, judicial reasoning, substantive order drafting, judgment preparation, bail or sentencing considerations, or any adjudicatory process. The ban extends further than most American observers would expect. It also covers sorting, classifying, or evaluating evidence, including summarization of depositions, credibility assessment, and relevance filtering.
The court was explicit about why. “Unregulated or unchecked use of AI carries the grave risk of gradual over-reliance on AI, less use of human mind, unintended biased decision making, which may cause subtle erosion of public trust in the human-centric nature of adjudication.”
On the permitted side, the policy is narrow. Judges can use AI for legal research, retrieval and analysis of case law, extracting the ratio decidendi of decisions, and identifying precedents. AI can assist with language, structure, and clarity of draft orders. Administrative functions like cause list management and statistical reporting are allowed, but only with anonymized metadata.
Every AI-generated citation, statutory provision, and legal proposition must be independently verified against authoritative sources before use. The court was direct about the hallucination problem: “The fact that a citation appears correctly formatted or internally consistent shall not be treated as evidence of its existence or accuracy.” That language reads like it was drafted by someone who studied the San Diego dog custody filing where fabricated citations made it into a final brief.
Why This Matters for American Lawyers
No U.S. court has issued anything this comprehensive. American courts have responded to AI with a patchwork of standing orders, local rules, and case-by-case sanctions. The Fifth Circuit requires disclosure of AI use. The Southern District of New York has sanctioned lawyers for submitting AI-hallucinated citations. Individual judges across the country have imposed varying AI certification requirements.
The Gujarat approach is structurally different. Instead of reactive sanctions after something goes wrong, it establishes a proactive framework that defines exactly where AI can and cannot operate within court functions. The distinction matters because reactive sanctions only work after damage has occurred. A judge relying on an AI-generated case analysis to inform a bail decision has already made a compromised decision by the time anyone discovers the AI was involved.
American bar associations are still debating whether to require AI disclosure in court filings. Gujarat has already moved past disclosure and into outright prohibition of AI in adjudication. Meanwhile, a Northwestern study found that more than 60% of federal judges are already using AI in their work. The gap between the two approaches is growing wider, and the U.S. approach looks increasingly insufficient.

The Accountability Framework
Gujarat’s policy also imposes personal accountability in terms that should make every American lawyer uncomfortable. Every judge remains personally responsible for every order, judgment, and observation issued in their name. That responsibility cannot be delegated to, shared with, or diminished by any AI tool.
The policy states explicitly: “The use of AI does not constitute a defence to a finding of error, misconduct, or professional negligence. Users cannot disclaim responsibility by attributing errors to an AI tool.”
Violations constitute misconduct and trigger disciplinary proceedings under applicable service rules, plus civil and criminal liability under India’s Information Technology Act, the Digital Personal Data Protection Act, and the Bharatiya Nyay Sanhita. This is not a suggestion. It is enforceable policy with real consequences.
The Confidentiality Provisions Are Equally Aggressive
No confidential case information, personal data of parties or witnesses, privileged communications, or sensitive data under India’s data protection law can be entered into any public AI tool. That includes free-tier versions of ChatGPT, Gemini, Copilot, DeepSeek, Claude, and Grok. Those tools are restricted to general, non-case-specific research only.
Even in approved enterprise deployments, witness identities in pending criminal matters and information subject to court confidentiality orders cannot be entered. The policy recognizes something that many American firms still ignore: public AI tools do not provide the confidentiality guarantees that legal ethics require.
What American GCs and Litigators Should Do Now
The Gujarat policy is not binding on U.S. courts. But it is the most thorough judicial AI governance framework currently in force anywhere. And the problems it addresses (hallucinated citations, over-reliance on AI reasoning, confidentiality breaches, erosion of human judgment) are identical to the problems American courts are wrestling with right now.
If you are using AI in litigation, start with three questions. First, does your AI use policy distinguish between research assistance and substantive legal analysis? If an associate is using ChatGPT to draft a summary judgment brief and then filing it with minimal review, you are in the same risk category that Gujarat just legislated against.
Second, do you have a verification protocol for every AI-generated citation? Not a general instruction to “double-check.” An actual documented workflow where every case name, every statutory reference, and every factual assertion produced by AI gets traced back to an authoritative source. If not, you are one hallucinated citation away from sanctions.
Third, are you tracking what information goes into AI tools? Attorney-client privileged communications entered into a public AI model may waive the privilege — that’s the exact issue in the Heppner ruling that sent shockwaves through the bar. Work product entered into tools with unclear data retention policies creates discoverable material where none existed before. Your AI policy needs to address data flow, not just output quality.
Gujarat’s high court put it plainly: “The core of adjudication, the weighing of evidence, interpretation of law, application of legal principles to facts, belongs exclusively to the domain of the human mind.” That principle is not specific to India. It is specific to the practice of law.
American courts will get there. The question is whether they get there proactively, like Gujarat, or reactively, after more sanctions, more blown cases, and more erosion of public trust in AI-assisted justice.
